Trial in Innsbruck – hefty fine: conviction for OStA Fuchs

Vienna’s chief prosecutor, Johann Fuchs, had to answer in Innsbruck on Wednesday for violating official secrecy and making false statements to Ibiza’s U-Committee. The suspended section leader Christian Pilnacek was the only witness invited to the regional court. He refused to testify and Fuchs was convicted.

Fuchs is said to have passed on parts of the file to Pilnacek in December 2020 through an advertisement from a journalist. Now he had to answer for violation of official secrecy and false testimony.

Pilnacek refused to testify
The section chief was the only witness called, but he refused to testify and referred to the pending disciplinary proceedings against him. Pilnacek had already been legally acquitted in the case. The disciplinary proceedings were started in the course of the criminal complaint.

Juicy fine
Fuchs had already been questioned in July and denied having passed it on to Pilnacek. The complaint against the editor was not prosecuted due to a lack of initial suspicion. The verdict will be announced on Wednesday afternoon. Fuchs was found guilty and fined 72,000 euros. The verdict is not final. The lawyer was threatened with a prison term of up to three years.
