The Provincial Court of Barcelona has acquitted all suspects in the so-called ‘Neymar case’. The verdict acquits the nine accused of the crimes of inter-individual corruption and fraud. In the trial, held in Barcelona last October, Sandro Rosell, Neymar, his father, Odilio Rodrigues, Josep Maria Bartomeu, N&N Consultoría, Santos and Barça were tried.

The case started following a complaint filed by the company DIS-Esportes, which held 40% of the footballer’s federation rights, and which believed that between the player, FC Barcelona and Santos had defrauded him to make him less pay for the transfer of the player. to FC Barcelona. The Public Prosecution Service had initially demanded two years in prison for Neymar and a maximum of five years for former vice president Rosell. But during the trial, the Public Prosecution Service changed its position. In reading out the conclusions, the Public Prosecution Service withdrew the charges against all the defendants and cleared the way for the acquittal that eventually took place.

The public prosecutor pointed out in his closing argument that although some of the defendants violated the civil code and the FIFA regulations “and with joy”, they did not, in his opinion, violate the penal code, as ruled in this judgment. process. . He said the DIS company had reasons to feel hurt, but it should have gone civil and not criminal.

The provincial court’s ruling indicates that the evidence conducted “does not result in indications that the player was offered a bribe” to sign for Futbol club Barcelona, ​​​​​​as stated by the DIS company. According to the court, the contractual simulation has not been proven and is also not intended to harm DIS.

According to the verdict, Futbol Club Barcelona, ​​through its president, Sandro Rosell, negotiated with Santos to sign Neymar in 2011. After a failed negotiation, the player extended until 2014 with the Brazilians. A termination clause of 65 million euros has been agreed in the new contract. But Santos president Luis Álvaro de Oliveira delivered the player a private letter authorizing him to negotiate directly with other clubs. This is what Neymar da Silva Santos, the player’s father, did.

He agreed an agreement with Barca under which the entity secured the player’s signing in 2014 when he was released in exchange for €40 million. The Camp Nou club guaranteed the player a minimum salary of 36 million in five years. Finally, in 2013, Futbol Club Barcelona and Santos reached an agreement on the transfer of the player for an amount of 17 million and not the 65 stipulated in the termination clause.

Barcelona concluded up to seven contracts with the player, with his father and with several companies represented by him, setting a higher salary than agreed in the 2011 negotiations. The employment contract, signed on June 3, 2013, included a transfer bonus of eight million paid to the player, which was not agreed in 2011. The club guaranteed the player that he would collect 45 million in five years, instead of the originally planned 36 million. For the transfer, DIS received the amount of six million, 40% of the 17 million.
