The Public Prosecution Service believes that football player Dani Alves, who has been imprisoned since January 20 on charges of sexual assault, should remain in prison. The Public Prosecution Service opposes the appeal of the Brazilian player’s lawyer, who asked the judge investigating the rape case for his provisional release with charges. His lawyer believes that there is no longer a flight risk for the former player of Barça and Sevilla, who put forward in other arguments that he has an address in Barcelona.
Instead, the Public Prosecution Service believes the opposite. In the document presented to the Court 15 of Barcelona, the Public Prosecutor’s Office confirms that “the rational indications of crime remain and the risk of escape remains”, requesting that the footballer remain behind bars during the investigation of the case. As an alternative to pre-trial detention, Alves’ lawyer, Cristóbal Martell, suggested other measures to the judge, such as handing over the passport and was willing to wear a telematics bracelet. In this way he wanted to refute the risk of flight.
The Public Prosecution Service also opposes these alternative measures, which in its opinion do not reduce the risk of flight or the indications of crime. Alves’ defense also asked for a hearing to decide whether or not the judge would release the footballer. But the court has not yet decided whether there will be one or whether the decision will be made immediately, after considering the parties’ pleas. Following the request for the release of Alves’ lawyer, the judge of District Court 15 of Barcelona asked the parties to establish their position on the case. The victim’s defense is missing and he has until Thursday to present his arguments to oppose the release of the alleged rapist. Nightlife employers Fecasarm and Spain Night Life have also asked to appear as a popular accusation, but the prosecution has resisted.
The judge justified her order to imprison him because of the footballer’s high risk of flight and also because of the high penalty that comes with a conviction for sexual assault. His lawyer is now trying to prove in court that there is no will to flee Barcelona.
Alves is accused of assaulting and raping a 23-year-old girl at Sutton nightclub in the Catalan capital. The events took place on December 30. First he said that he did not know the victim, then that he ran into her in the local toilets and finally that there were relations, but consensual. The Brazilian eventually claimed that he initially did not admit to the relationship to try and hide an infidelity to his wife. The victim, on the other hand, has stuck to the same version since the beginning of the case. He assured that he followed the footballer without knowing that they went to the bathroom. Once inside, he beat her and raped her.
The footballer’s wife, Joana Sanz, visited the player in prison yesterday. “I’m not going to leave him alone at the worst time of his life,” he said after leaving Brians 2 prison in Barcelona’s Sant Esteve de Sesrovires.
