This Monday, dawn or dusk, the tad will open a disciplinary file Luis Rubiales after the complaint sent by CSD last Friday where they described as “very serious” the performance of the federative president; now carefully suspended.
From 1:00 pm all its members were summoned. Once this happens, it will also allow “the adoption of a precautionary measure and the temporary suspension of Luis Rubiales as president of Royal Spanish Federation“, as requested by CSD in the same letter.
Once this happens, the CSD will meet with its Board of Directors, so that it temporarily suspends Luis Rubiales during the time it takes to process them. In other words, while the TAD takes statements from the parties and gathers information, it can temporarily suspend its duties Luis Rubiales. And this could happen by the middle of next week
Who makes up the CSD Board of Directors?
There are fourteen members of the Board of Directors, which is chaired by the Secretary of State and of which the General Director of Sports of the Higher Sports Council is the vice-president. Representing the General State Administration are three members directly appointed by the President of the Higher Sports Council. On behalf of the Autonomous Communities, a member also appointed by the President of the CSD himself. In the representation of local Entities, there is another vowel.
The body is completed with two members of sports federations, three more representing the COE, Paralympic Committee, professional leagues and associations of professional athletes. In addition, a representative of the State Legal Service and the Deputy Director General of the CSD Legal Regime are part of the Board of Directors with voice but no vote.
Among the powers is precisely the ability to suspend the presidents of the federations: “Suspend, with reasons and in a precautionary and temporary manner, the President and other members of the governing and control bodies of the Spanish sports federations and professional leagues.”
Three women in the current composition of TAD
The TAD was just renewed in May. After this last change, this last sports body is composed of Francisco de Miguel Pajuelo, Social Security Lawyer; Eva Fernández, State Attorney; Pilar Juárez, professor at Carlos III University or Alfonso Ramos del Molins, State attorney. The body was completed by Marina Adela Porta Serrano, State attorney, Guillermo de Blas Bados, also State attorney and Jaime Caravaca Fontán.
Penalty of disqualification from two to fifteen years
The CSD relies on its complaint sent to the TAD in article 104 of the Sports Law and which includes the very serious:
i) Well-known and public acts that violate sports dignity or etiquette.
j) Abuses of authority.
And according to the Sports Law itself, the penalties to which it is exposed are:
.- Fine, not less than 3,000.01 or more than 30,000 euros.
.- Prohibition of access to stadiums or places of development of tests or competitions for a period not exceeding five years.
.- Disqualification from holding positions in sports entities for a period between two and fifteen years, in sufficient proportion to the offense committed.
.- Suspension of the federative license or equivalent authorization of a temporary nature for a period between two and fifteen years.
