Joaquin Aguirre LopezTitular Magistrate of the Investigating Court number 1 of Barcelona, has agreed not to process the request presented by RFEF on May 5, 2023 ordered by the president Luis Rubiales and Andrew CampsSecretary General of Real Spanish soccer federationaccording to which he requested the imputation Albert Soler, former director of Institutional Relations of FC Barcelona and of Professional Sports between 2014 and 2021for crimes of administrative prevarication and dereliction of duty to prosecute crimes in the framework of the investigation of ‘Case of Negreira‘.
The brief was accepted on May 8, 2023 but an Order was agreed to on August 9 to exclude Royal Spanish Football Federation (RFEF) as a private indictment, in the way it is left in the present process. That’s why the Legal Foundations of Denial Order of Imputation state the following: “Since the imputation of Mr. Albert Soler for the crimes of administrative prevarication and omission of the duty to prosecute crimes was requested by an accusation that no longer has that status, which is not included in this process, No other solution but not to decide on the new accusation made against Mr. Soler. In any case, even if the RFEF is part of the process, the request must be rejected, due to the application of article 17 of the LECrim, the new accusation must be subject in a separate process corresponding to another court. Consequently, the RFEF should have withdrawn its claim before the judicial body that may have competence and did not intend to add it to the current process, which is followed by some very accurate facts: the payments made for FC Barcelona to the family Negreira. It is clear that the conduct attributed to Mr. Soler does not have the very close relationship required by the current article 17 to agree the accumulation, which should no longer be accepted since its publication.
Individual parties may file an appeal for reform in writing to the same Court within three days.
