The CSD could change the entire electoral process in the RFEF

Yesterday at MD We exclusively tell you about the letter sent on February 5 from RFEF to CSD about how to resolve the existing legal vacuum for calling elections. The order that controls the electoral processes in Spanish sports federations establishes that the person holding the presidency of the federation or the Board of Directors calls the elections, as provided for in the respective Laws. Organization that does not currently exist in the RFEF constituted as Management Committee since last September 15 with Pedro Rocha as acting president.

The RFEF offers in the same letter, based on the Civil Code, to carry out a similar application of the rules through the Federal Statutes. They stipulate in their article 31.8 that it is the Managing Commission or whoever holds the presidency on a temporary basis.

But now it is CSD and TAD who should respond. Whether they allow it or not. Because if this is not the case, the RFEF may have to call elections immediately but only for the presidency and under the current 139-member Assembly. A process that will be shorter.

Once the new president is elected, a Board of Directors will be established, which will be the one that will take the call where the RFEF is currently underwater. That is, the same for the new Assembly of 143, presidency and Delegate Commission.

Which brings us to not having a new president and Assembly until next September after the Euro Cup and Games.

As we already explained in MD at the time, it is not possible to vote in the month of the Euro Cup or August. This is what the electoral regulations say, which in its second additional provision related to the non-working period for presenting candidates or holding elections says that. “The month of August, as well as the period between December 20 and January 6 and the five business days before and after Maundy Thursday shall not be considered business days for the purpose of presenting candidacies or holding votes. .”

And it is in a further third where he talks about the incompatibility of holding elections and competitions. “On days when official, national or international sporting events or competitions are scheduled to be held with the participation of Spanish clubs or athletes, in the corresponding sporting modality, elections for members of the General Assembly cannot held, or the voting to choose those who should occupy the Delegate Commission or the Presidency of the Spanish Sports Federation.”

Another option could be that the president who is now elected in these only presidential elections will remain in office until after the summer and the two big events. And that’s what he calls them. Something that the rule enables because it is an Olympic federation participating in the Games. And these may delay the electoral process in the second half of 2024.

It is now up to the CSD to respond after last October, as we reported in MD, it allowed the RFEF to carry out its electoral process in the first half of the year.
