This Tuesday the UEFA made official the bases for the disciplinary file opened in Rodri and Morata following his words “Spanish Gibraltar” which took place at the celebration on July 15 at Madrid after winning the Euro Cup. A procedure that opens as a result of a complaint from Gibraltar Federation.
UEFA levied several charges against both players. All are included in article 11 of the Disciplinary Code regarding general principles of conduct.
On the one hand there is “Breaching the basic rules of decent behavior” as well as “Using sporting events for non-sporting events” and finally “Destroying the sport of football, and UEFA in particular”. All parts of the complaint of Gibraltar Football Federation which explains why UEFA opened this extraordinary procedure and the appointment of an instructor.
We can see why, as we have already explained in MD last Saturday, any punishment greater than a warning, financial fine or something greater than two penalty matches will mean the case will go to CAS and that’s where we’ll see the final decision of Swiss Sports Court.
This is stated in the UEFA Statutes itself in article 63.1 where it states that “the TAD is incapable of dealing with: a) matters related to the application: decisions where a natural person is suspended for up to two matches or one month. And here we can see where the limit of freedom is.
The main question that arises is: is the title celebration a sporting event? Twenty-four hours after the end of European Cup and in a completely different setting than a venue like the Berlin Olympic. The chants took place at a time and place unrelated to a sporting event. This was confirmed by sources consulted by UEFA.
Croatian Lovren’s precedent with Spain in 2019 and his “cowardice” with Ramos
The antecedents of the Turkish Demirahl and the Albanian Daku, both of which allowed two matches, do not serve as examples because they both had a clear political character and also took place in the very stadium where the matches of European Cup. It’s the same behavior Bellingham after scoring a goal and was fined financially in addition to a suspension of one match under the threat of one year. It was considered contempt.
The most similar precedent is certainly that of Spain as the protagonist. This is the Nations League match in between Spain and Croatia which ended in a 3-2 Croatian victory. At the end of the match, he uploaded a message to the networks in the changing rooms of the Maksimir stadium in Zagreb where he admitted that he had elbowed Ramos and sent this message: “colleague, they are a bunch of cowards. ” The player has been suspended for one match.
The UEFA rule speaks of a maximum of one match
The regulations are exact UEFA In article 15 of the same Code, “unsporting conduct” is among the possible options for a sanctioning match. And this is the scenario that applies to both players. That is, from warning, reprimand, fine and this sanction. Anything higher will go to CAS with the risk of UEFA losing it.
Players may request legal assistance from the RFEF
Now it remains to be seen if the players will prepare the allegations in their personal capacity or if they will leave it in the hands of the RFEF, although the procedure is only for footballers.
