Brazil’s Supreme Court began a virtual trial Friday to review the former soccer player’s request for release Robson de Souza ‘Robinho’, in prison since last March for a rape conviction, and the session was adjourned after a judge voted against habeas corpus.
Judge Luiz Fux, rapporteur of the case, voted against the release, allegedly in the order of imprisonment of Robinho “There is no violation of constitutional norms,” as alleged by the defense of the former player, among others, of Real Madrid, Milan and Manchester City.
No date has been set for the case to continue
The trial was immediately suspended after the request of another magistrate for a hearing and so far there is no date to resume the examination of the case.
Robinho entered a prison in the state of São Paulo on March 22 after a Brazilian court approved a 9-year prison sentence in Italy for a gang rape committed in 2013.
The attacker’s lawyers have filed a habeas corpus request to release their client until the Supreme Court definitively decides whether the sentence handed down by the Italian Justice can be delivered to Brazil.
The defense maintains it has the right to appeal
The defense says that Robinho, 40 years old, He still has the right to present some appeals to a higher court, so his judgment cannot be considered final and definitive.
The former footballer He was convicted in Italy in 2017but Robinho could not be imprisoned because before the trial ended he returned to Brazil, where the Constitution prohibits the extradition of its citizens.
The Italian authorities have asked the Brazilian Justice to approve the sentence and, consequently, determine the imprisonment of the former soccer player so that he can serve the sentence in his country of origin.
After the decision of the Superior Court of Justice to approve the sentence, Robinho was taken to the prison of Tremembé, within the state of Sao Paulo.
