VfGH decision – bang! Huseyn’s deportation was illegal

The Constitutional Court decided faster than expected on Huseyn Salimov (13): According to the highest judges, the deportation decision was illegal. The Constitutional Court considers the rights of the Azerbaijani family violated and partially overturned the decision of the Federal Administrative Court. This gives new hope for a return.

Walter Windischbauer, Vice-President of the UTTC Salzburg, is overjoyed: today, Thursday, the decision of the Supreme Court reached him. “In my opinion, this sets the course for the return of Huseyn and his mother. We are trying to get them back as soon as possible.” According to the findings of the Constitutional Court, Huseyn and his mother have been violated by the Federal Administrative Court’s decision in the “constitutionally guaranteed right to equal treatment of strangers”, which they have appealed.

Expelled in February after six years
As reported several times, the immigration police evicted Huseyn and his mother from their home in Salzburg in mid-February. Despite protests from classmates and table tennis colleagues, the family was sent back to Azerbaijan. They have lived here in Salzburg for six years and according to Windischbauer, they have integrated well. Huseyn is even considered a great table tennis talent. Thousands also signed an online petition to return.

The deportation also sparked political backlash, even the National Council was working on the Huseyn case: NEOS MP Stephanie Krisper made a corresponding request to the Home Secretary. Recently, however, there have been setbacks: the authorities have rejected Huseyn’s application for a student visa. But now, thanks to the Supreme Court decision, there is renewed hope that the Salimovs will return.
