“If you skip school, you’re back in jail,” Judge Margit Kreuzer told a 14-year-old suspect. Since turning 14 in March 2022, the teen had suffered a string of crimes. The fact that he stole a stamp from the officers during the police interrogation was one of the most innocent offences. He would also have sexually abused two girls (11).
Child or crook? The 14-year-old is suspected of aggravated theft, coercion, material damage and burglary, but also, which is unusual for such a young suspect, sexual abuse of minors. He allegedly harassed two 11-year-old girls on a football field, pressed their heads to his stomach and followed them to the toilet. He also took the cell phone from one of the girls. He later allegedly tried to force her to drop the charges against him.
The confession of the sex crimes was the hardest thing for the teen to say. “Because he is ashamed to talk about it in front of others,” the probation officer said. After a pause in the trial, he also pleaded guilty.
Threatened to be stabbed
In the process before the youth jury, however, the theft with violence was decisive. Along with a younger, even less criminal friend, whom he described as the driving force behind the crimes, the Ukrainian-born boy allegedly pushed a youngster and threatened to stab him with a knife. Since they didn’t steal anything, the robbery was considered an attempt. However, the sentence of seven and a half years remained.
The judge wanted to know from the young crook whether the police stamp theft had been a test of courage. “The police were brutal,” was the reply. Above all, he and his accomplice were brutal. For example, when they stole a megaphone from the conductor’s compartment on a train and threw it out the window.
detention and instructions
The young suspect has been in custody since July 4. After his release, he wants to return to his mother, but is closely monitored by the probation service and youth care. The verdict: 15 months in prison, of which four months unconditionally. However, the teenager was allowed to leave Linz prison on Monday. In order to complete the last year of school, a two-month unconditional sentence was granted on a conditional basis, as it is called in legal German.
The judge and prosecutor told him that for the smallest offences, he could end up back in prison. And he was also instructed to apprentice after school. The court will check that.
