Because students with their main residence outside of Vienna had to pay twice as much for the semester ticket, a class action lawsuit came up. That has now been achieved: the recoveries already amount to four million euros.
Those who commute to Vienna to study, but have their main residence in another state – such as Burgenland – have to dig much deeper into their pockets than students who have their main residence in the federal capital.
Unequal treatment not justified
Wiener Linien charges students outside Vienna 150 euros for the semester ticket, while residents of Vienna only pay 75 euros. An unequal treatment that is not justified according to the final decision of the competent regional court.
In the course of a design lawsuit, the platform “Ticketersatz.at” demanded reimbursement of the price difference and 300 euros per semester ticket for the personal limitation suffered. This model lawsuit went through several authorities. It is now fully approved.
Four million euros recoveries
Affected students are entitled to 375 euros per semester ticket. 3,000 affected people have already joined the collection procedure. The recoveries amount to more than four million euros. Those involved can still join the collection procedure.
Of the amount, 73 percent is paid out to the students, the rest is retained by the platform for administration costs and taking over the risk of legal costs.
