Death after drug party – parents of Max (16) demand compensation from the country

16-year-old Max (name changed by the editors) died in 2020 after a drug party in Innsbruck. The parents and lawyer are now demanding compensation from the state of Tyrol. “Max could still be alive,” they emphasize.

In the form of a six-part series, the “Tiroler Krone” reported on the tragic “Max case” in late August or early September of this year. His life came to an abrupt end when he was only 16 years old.

Before the night of his death, the teen was at a drug party in Innsbruck. This happened in an apartment cared for by a Tyrolean youth institution. “This apartment was, as it were, made available to young people by child and youth care. They had custody of him, he was housed through the independent association Jugendwohnstart,” said Markus Abwerzger, the family’s lawyer.

Max was a person younger than 18, so a minor. In principle, according to the lawyer, it is clearly the task and duty of child and youth care services to guide young people accordingly. “However, in this case and in other cases, this has not happened. The supervision in the apartments of the Jugendwohnstart association was more than inadequate and incomplete. The mandatory night checks sometimes don’t take place at all,” explains Abwerzger.

“Young people were left to their own devices”
Even on the eve of the 16-year-old’s dramatic death, there was no control whatsoever and the young people were left to fend for themselves. “Child and youth care has thus grossly neglected its supervisory task,” sums up the lawyer.

The child and youth care services were also aware that there had been an increase in drug use and illegal drug parties in such apartments before. “There is no doubt that this is a violation of supervision,” said the lawyer.

‘The young Tyrolean would still be alive’
Moreover, there is no doubt that the causation is that “if the child and youth services had fulfilled their task, such a drug party would not have taken place in this apartment and in the end there would not have been such excessive drug use and, above all, the youngster would not have died. The young Tyrolean would still be alive”, Abwerzger is convinced.

A claim is now pending. “As a legal entity responsible for child and youth care, I have to ask the state of Tyrol to first make a statement about who is responsible for liability – within a period of 14 days,” explains the lawyer. The letter of formal notice is available for the “Tiroler Krone”.
