After an orgy of violence – that threatens the chaos of the Halloween riots

What to do with those young people who sow fear and terror in Linz on Halloween? This question arises after the riots. The “Krone” asked what was wrong with the perpetrators and what would happen next.

It sounds a bit complicated in legal German: “Anyone who knowingly participates in a gathering of many people whose purpose is to use their combined powers to cause murder (section 75), manslaughter (section 76), bodily harm (sections 84 to 87) or serious damage to property is committed, if such an act of violence has taken place, is punishable by imprisonment for a maximum of two years” – insofar as § 274 StGB. Anyone who played the leader or instigated him to do so faces up to three years behind bars.

This paragraph was known as a “peacebreak” until the 2015 amendment. It is used quite rarely. In Linz, Ulrike Breiteneder of the public prosecutor’s office is best known for the case in which boys poured petrol over a police car in Linz-Ebelsberg and set it on fire in November 2021. The man who got the fuel was sentenced to six months in prison after the “274er”. But what does that mean in concrete terms for the Halloween chaos in Linz?
