In October 2020, an asylum seeker from Afghanistan stabbed his then 17-year-old girlfriend and mother of his son with a kitchen knife. The Linz Supreme Court ruled on Tuesday that the subdistrict court judge’s sentence was “a little too lenient”. And increased the prison sentence for the 20-year-old from 12 to 13 years.
Both the accused and the prosecutors appealed the verdict. The Supreme Court had already rejected the asylum seeker’s appeal for annulment and the Higher Court ruled on the sentence on Tuesday. And stated: The aggravating factors had not been sufficiently taken into account. The court followed the prosecution, according to which more account should be taken of an existing conviction and the fact that the young man stabbed the mother of his child.
The suspect said in court on Tuesday that he “regrets everything” and “I admit everything”. Still, he wanted “a bit of a lesser sentence.” The minimum age for attempted murder is ten years. The court did not address an attorney’s argument that his client had let go of the victim when she was defenseless. The Higher Court also saw differently that a kitchen knife was not a weapon.
On-off relationship ended with knife wounds
The suspect and the young woman, who lived in a group home at the time of the crime, were in an on-again, off-again relationship. They have a son together who lives with a foster family. According to the defendant, there were often disputes about visiting rules. She, on the other hand, described the child’s father as “very jealous”.
On October 18, the couple again argued in the room of the then 17-year-old. During the argument, the suspect took a knife from the kitchen and stabbed her in the neck. When she managed to take the knife from him, he grabbed another and continued the attack. The young woman suffered a total of eight stab wounds, mainly in the neck. The injuries were potentially life-threatening, medical experts said.
