Despite promises, a Kosovar suddenly did not receive an Austrian passport. Because he did not adhere to a speed limit, the authority said. But now the Supreme Court intervened.
He has been here since 2010, has a wife and two children, works as a fleet manager for a local company and wants to become an Austrian. This refers to a Kosovar who applied for citizenship in September 2017. But now the man no longer has a passport and is considered stateless because the authorities made mistakes.
In October 2020, the country assured him that if he gave up his Kosovar passport, he would get the Austrian passport. Said and done. On December 11, 2020, the man lost his Kosovar passport. But in late April 2021, the authority revoked the pledge to grant citizenship.
Supreme Court Admits Errors by Authorities
Reason: a speeding fine in traffic. In October 2020, the man had exceeded the 100 km/h speed limit. The state administrative court confirmed that the authority denying him naturalization — with reference to other minor administrative penalties — was a “serious criminal offence.”
Wrongly, as the Constitutional Court has now explained: such an official decision “must be based on particularly important, new circumstances”. This is not the case. The country has to bear the costs of the procedure and the stateless person can now hope for an Austrian passport.
