Convicted MP Imran Ahmed Khan has been expelled from the Conservative Party after being found guilty of sexually assaulting a 15-year-old boy.

The Wakefield MP’s legal team has pledged to appeal the convicted man, a move that could delay a potential by-election.

Here’s what can happen after faith.

If Khan is imprisoned for more than a year, he will be automatically disqualified by Parliament and a by-election will be held in his place.

In the event that a sentence of less than a year was passed, he was allowed to continue as a Member of Parliament and lodged an appeal.

If he does not appeal, he will be subject to a recall.

– What is memory?

According to the House of Commons Library, the challenge is the process by which voters can hold a special election to impeach a Member of Parliament after the election deadlines.

Memory systems usually include two phases.

First, a petition will be submitted to request the removal of an elected representative.

If enough people support it, it will result in the person being expelled and new elections being held.

Most recruitment cases result from wrongdoing or inadequacy on the part of an elected official.

– What law provides for compulsory recruitment?

In the UK, the Parliamentary Challenge Act 2015, which went into effect in March 2016, allows a member of Parliament to lose a seat and hold a by-election if a local petition to challenge it is successful.

How does the anniversary happen?

The invitation is only valid for members and the application can only be launched if one of the three conditions is met:

  • The attorney was convicted of a crime and faces a prison sentence of one year or less.
  • A Member of Parliament is suspended from membership of the Parliament for a period of at least 10 days or 14 calendar days.
  • The MP was convicted under the Parliamentary Standards Act 2009 for seeking compensation for providing false or misleading information.

The first and third conditions are satisfied only after the courts have considered a potential complaint.

Members of the public cannot initiate a petition.

– What would happen if general elections were held?

A motion of no-confidence cannot begin if a general election is to be held in the next six months.

If an early general election is called, any petition procedure will be put on hold.

The request for dismissal shall be suspended even if the representative leaves office.

How is the job application process?

If one of the required conditions is met, the Speaker of the House of Commons notifies the Petitions Officer in the Member of Parliament’s constituency.

The latter will be the returning officer.

The Petition Officer will decide where and when to sign the petition, with a maximum of 10 seats at the college selected for personal signature.

Unless this is possible, the officer must specify the date of opening the petition on the tenth business day after receiving the speaker’s communication.

The petition remains open for six weeks from the date of its opening. It will be fully funded by the government.

Signature venues must be open Monday through Friday, from 9 a.m. to at least 5 p.m.

Who can sign the petition?

The petition may be signed by any person in the House of Representatives registered to vote in parliamentary elections on the day the Speaker of the House receives the notification.

If there are multiple places to sign, a similar district will be allotted to the electorate.

Voters will place their signed ballot papers in a sealed ballot box, or they can request a signature by mail or by proxy.

What must be done to make the petition successful?

The petition requires 10% of constituency voters to support it in order to be successful.

The result is sent to the rapporteur, the deputy seat remains vacant, and by-elections are held.

The recalled member has the right to participate in the by-elections.

Has the leverage actually been used?

In July 2018, a subpoena petition exploded when Democratic Unionist MP Ian Beasley Jr. was released from the public 30 days after he failed to register two family leave paid by the Sri Lankan government.

But his enlistment petition in North Antrim County failed, having the support of only 9.4% of voters.

Another draft of the petition began in March 2019 after Labor MP Fiona Onasanya was sentenced to three months in prison for perjury in December 2018.

The challenge was successful, with more than 25% of registered voters signing the petition and Onasanya not running in the next by-election.
