Decision made – Lifebrain wins dispute with medical association

The administrative court draws a line: Complaints from the Vienna Medical Association against the testing giant Lifebrain have now been finally dismissed. So it goes on with “Everything gargles”.

A legal dispute between the Vienna Medical Association and the testing giant Lifebrain has been smoldering for a year and a half. Now the administrative court has rendered a final verdict in favor of the provider “Gargle everything”. The approval by the Viennese state government, which was questioned by the medical association, was rightly granted, lawyers for director Michael Havel explained on Tuesday in the course of a background discussion. In addition, it is stated that the “needs assessment” required by the Medical Association was never necessary.

“From the beginning, it was difficult for us to understand why the Vienna Medical Association set aside its most important task of protecting the health of the Viennese to protect its customers from new entrants to the market. Because if the approval notice was withdrawn, Austria’s largest laboratory should not have operated at the height of the pandemic,” said the Lifebrain chief.

At the start of “Alles gurgelt” in December 2020, a test would have cost 130 euros, but Lifebrain undercuts this with six euros each. Havel also sees the lawsuit against himself personally: “In the past I had some legal disputes with the medical association.”

No further layoffs planned
At peak times in January/February this year, Lifebrain evaluated 460,000 PCR tests per day. Meanwhile, the pandemic situation has eased, with around 30,000 tests arriving at the Baumgartnerhöhe every day. As a result, 1,000 of the previously 1,700 employees had to be fired in advance. While it’s unclear how long the free trials will be available, no further terminations are planned for now.

Michael Havel is sure that the test infrastructure needs to be maintained. “If there is a new variant, we can start again within ten days,” Havel says.
