Day three of the negotiation marathon over the ex-Greens Christoph Chorherr starts with a peculiarity: Judge Michael Tolstiuk presented the letter from a lay judge. In it he said that he wanted to retire as a lay judge. The reason for this is an incident in the chamber of judges on 8 November. There, a jury asked how long the trial would take. The examining magistrate is said to have replied: “Until everyone is convicted!” – Moreover, not all lay judges received the indictment and counter-declarations at the same time.
“I felt different”
Judge Tolstiuk projected the letter onto the wall of the main courtroom: “I want full transparency,” he said. He would have cleared up the misunderstanding in a conversation with the lay judge, which he confirmed. At the request of lawyer Rami, the session was then interrupted, after which the lay judges were questioned individually: “I heard the statement, but I felt it differently. So that it can end positively or negatively,” said one. Another also confirmed the wording of the statement, while others can’t remember. However, there was no extensive support for the colleague.
The hearing was interrupted again.
