Gang Rape – Trial Officer: “I expect acquittal”

How is it possible that all four suspects in the case of the alleged gang rape of a schoolgirl (16) in Linz were released after only two weeks in custody? “It’s no surprise to me,” said Wilhelm Deutschmann, a 15-year-old trial assistant to an accused Afghan man.

Wilhelm Deutschmann (53) is actually a commercial lawyer and specialist in restructuring and insolvency law. The enthusiasm that he was chosen as a legal assistant (duty defender) for the Afghan (15) who is suspected of murdering a schoolgirl (16) on a stairwell with two compatriots (15 each) and an Iranian (14) to reach 30 March for more than an hour near Linz Central Station was initially about to end.

“However, when reading the law, I noticed inconsistencies that raise a number of questions. A lot of what the victim claims just doesn’t make sense to me,” Deutschmann explains.

Contradictions and memory gaps
The 16-year-old would contradict himself in a number of statements or refer to gaps in memory. “It is strange that the girl has no injuries or bruises on her arms, neck or legs that indicate violence,” said the trial secretary. The student also had no defensive injuries and is said to have screamed only once. “According to my client, the sex was voluntary.”

Visiting Afghans
According to Deutschmann, the Afghan had known the 16-year-old for about a week and the alleged victim had even visited him at home in Linz: “His father could confirm that too.” Buying a condom at the train station is also unusual. “He says she contacted him – that’s why he voluntarily turned in his cell phone for inspection.”

There were also no weapons, drugs or alcohol involved. Deutschmann: “Something stinks there. I expect an acquittal in court.”
