A 34-year-old Somali man had to answer to the Innsbruck court after raping a young woman. The jury decided on a verdict close to the maximum sentence – not final.
The end of a mild summer night now took place in the courtroom: on the night of July 30 to 31, 2022, the Somali citizen allegedly approached the drunken young woman in a bar in Innsbruck, lured her into a nearby corridor and had sexual intercourse that you there against her will. “She really wanted it,” he said at the beginning of the trial. He later softened that statement: “She wanted to at first, but later screamed during intercourse.”
Cocaine together? There was no evidence of this
The Somali also claimed to have previously used cocaine with the young woman and her friends. “But that could not be proven in the woman’s blood,” judge Norbert Hofer emphasized. He thus refuted the defendant’s allegation in this regard. Hofer also vehemently contradicted his versions of the partially consensual intercourse: “There was no way the young woman wanted to have intercourse.”
On the other hand, he testified that the woman, whose video interrogation took place behind closed doors, was extremely credible. The prosecution also agreed in his closing argument: “There is no doubt that she was raped.” Whoever screams for help is definitely not having consensual sex, he stressed.
Friends confirmed incident
These calls for help were also confirmed by two friends with whom she had previously celebrated. “We looked for her after a while and then heard the screaming outside the bar,” they described the situation in unison. When their friend finally stood in front of them with her pants and blouse undone, they both “knew what had happened”. The nine-year sentence was just below the ten-year sentence – not yet final.
