“There is no deterrence” – Kellermayr case: Lawyer threatened by the same group

Würzburg lawyer Chan-jo Jun has now also spoken out about the tough investigation into the case of Upper Austrian doctor Lisa-Maria Kellermayr, who was murdered by hate posters. He was chased by the same group of criminals. The German lawyer not only criticizes the harsh investigations, but also the low sentences.

In the case of doctor Lisa-Maria Kellermayr, who was allegedly killed by corona deniers, the investigations are going heavy. There are reportedly three suspects in Berlin and Munich, one of whom is hiding behind a pseudonym. They are said to be behind the hate messages that ultimately led to the suicide of the Upper Austrian rural doctor in July 2022.

From Germany, Würzburg lawyer Chan-jo Jun, who in the fight against hate posters does not shy away from legal proceedings against social media platforms such as Twitter and Facebook, has now reported to the “Krone”: “I was pursued by the same group of criminals as Ms. Kellermayr, received almost identical threatening emails,” says the 48-year-old, who legally handled silk cherry claims during the Corona period and was therefore also publicly exposed.

Crimes are not taken seriously
The content of the hate messages sent to him is so horrific and vile that it is not shown here. “The threatening letters put a lot of pressure on the whole team and affected us enormously,” he recalls. But the worst part is that these offenses are not taken first – nothing happens until something happens.

“There is no proportionality”
Jun not only criticizes the harsh investigations into hate messages, but also the imminent fine. In the case of the two suspects from Berlin, “threats” are being investigated – the perpetrators are only concerned with a fine or imprisonment of up to one year, which – if any – can also be imposed conditionally. “A prosecutor has to justify how he spends his time. For him it is ‘worth it’ to bring a tax offense to court, for example,’ says Jun. The proportionality is simply not given.”

Offenders sit back and relax
Although great harm is done to the victims – that is, people who are publicly involved. According to the lawyer, Austria is more advanced than Germany in terms of legislation, but the laws must also work in practice. And the drama surrounding Lisa-Maria Kellermayr shows dramatically how much room for improvement there is. The perpetrators sit back: “You can see that the method works well and will probably continue to work well in the future” – the much-needed deterrent is missing.
