Victim lawyer Herta Bauer detects investigative errors in assaults involving a Viennese sports teacher. In the educator’s case, data seized with depictions of underage and minor sexual abuse—some of which he produced himself—may not have been able to be evaluated until late.
During a house search in the spring of 2019, a total of 22 data carriers were seized from the teacher. Three notebooks, eight hard drives, a USB stick, a memory card, five digital cameras, three mobile phones and a tablet contained more than three terabytes of photo and video material.
“Typo” instead of too late
According to a report by “Presse”, the investigation and security of the mobile phones and tablets was completed on July 29, 2019. However, according to the file, the evaluation of the other data carriers was not completed until September 13, 2022. Nina Bussek, spokeswoman for the Vienna public prosecutor’s office, stressed that the second date was a “typing error”. In 2019, all data had already been evaluated.
For victim lawyer Bauer, who represents several victims, “even a typo would be a serious failure of the authorities”. In addition, a message from the National Investigation Department (LKA) of 5 June 2019 showed that patience was actually required for the assessment of the data carriers seized from the lecturer. The LKA notification must state that a back-up of the electronic data carriers “cannot be expected earlier than approximately 1 1/2 years”.
