Nevertheless, the pension insurance institution decided that the man could only receive healthcare allowance level 5 (€ 1,024.20 per month).
The man felt that he had been treated unfairly, contacted the Labor Chamber and they also concluded that the classification was too low. So she went to court on behalf of the victim. There, too, after examining all the documents and a new report, they were of the opinion that the man was entitled to the highest possible nursing allowance, namely 7.
What does care level 7 entail?
At this level, nursing effort exceeds 180 hours per month and there is no specific movement of the four extremities with functional performance. For example, the ability of a purposeful movement exists when a spoon can be picked up. If this spoon is then used for eating, it is a functional version.

As a result of this decision, the man now receives 1,879.50 euros and therefore has 850 euros more to live on per month. Remarkable detail: During the hearing it turned out that even the assessing physician of the PVA had proposed level 7 healthcare allowance, but the PVA had decided on a lower level. She only admitted after the court ruling.
