Attempted murder in a taxi turned into self-defense. A 20-year-old was found guilty by the court in Gmunden (Upper Austria). However, the verdict is not yet final.
In May 2022, an argument broke out in a taxi in Vorchdorf, which ended in a stabbing. A then 19-year-old German from Vorchdorf was detained for three months and an investigation into attempted murder was underway. But then came the turning point: it was self-defense. On Thursday, the suspect “only” had to answer before the court of Gmunden for negligent bodily harm due to excessive self-defense and failure to provide assistance.
Pre-trial detention deducted from fine
Before the trial, the attorney said his client would plead “not guilty.” But there was another twist for the judge. In consultation with his lawyer, the now 20-year-old pleaded guilty. “That was the best for my mandate. Otherwise, the case would have been referred back to the regional court,” explains Lampl.
The suspect, the victim, the taxi driver and two other witnesses gave their version. The victim barely remembered the incident and was heavily intoxicated at the time. In the end, the suspect was found guilty and received a four-month suspended prison sentence and a fine of 300 daily rates of four euros each. Since he had already been in custody for three months, the fine was reduced to 180 daily rates.
