LVT Detects Threat – Naturalization Denied for Terror Night Hero

Date:

A native Palestinian who became known in the center of Vienna as the “hero of the night of terror” failed to apply for naturalization in Austria. At the end of December, the responsible municipal office of Vienna 35 informed him that the granting of citizenship was “currently not possible”.

According to “profile”, the State Office for the Protection of the Constitution and Counterterrorism (LVT) states in its report that Osama Abu El Hosna “continues to appear in the vicinity of the terrorist group Hamas”. Obtaining citizenship would therefore “constitute a significant threat to the public security of the Republic of Austria”.

At the request of APA, MA 35 explained that an executive had to abide by case law: “If there is a risk report from the State Office for the Protection of the Constitution and Counter-Terrorism, it is an impediment to naturalization.”

Rescue Medal Awarded
In the attack in Vienna in 2020, the stateless person, who has been living in Vienna as a recognized refugee since 2013, brought a police officer shot by the assassin from the danger zone to paramedics and thus saved the life of the agent. The mayor of Vienna, Michael Ludwig (SPÖ), awarded him the “Rescue Medal of the State of Vienna” for this.

However, Osama Abu El Hosna himself was the target of the prosecutor’s office in Graz during “Operation Luxor”, a major raid on the Islamist scene in November 2020. The reason was his work at an aid organization that, according to the researchers, would have forwarded donations from Austria to an “possible sphere of influence of the terrorist organization Hamas”.

procedure already established
However, the Graz Regional Criminal Court dropped the case against Abu El Hosna last September because there was “no concrete evidence that would support the assumption of Hamas membership”. The preliminary investigation against the accused association was also stopped. The main office of the Vienna State Police therefore expressed no concerns about naturalization last autumn.

In contrast, the fact that the LVT continues to attribute Vienna Abu El Hosna to the Hamas environment has come under heavy criticism from its lawyer, former SPÖ secretary of state Muna Duzdar: “The LVT report is purely arbitrary. These are baseless allegations with no basis in fact. This procedure is highly dubious from a rule of law point of view.” According to “profil”, Duzdar will file an official liability claim against the Republic as their client will be financially damaged by the LVT report, which is contrary to the facts.
