France means it – the right to abortion should be in the constitution

The French Senate has paved the way for women’s freedom of choice to have an abortion to be incorporated into the constitution. The senators passed a similar bill Wednesday evening. The background to this is the decision of the highest judges in the US last June to clear the way for abortion bans.

The left-wing opposition hailed the passage as a “historic victory” and “great progress for women’s rights”. The majority of the conservative opposition voted against. “The right to abortion is not under threat in France,” said Senate Republican leader Bruno Retailleau. “The Constitution is not there to send symbolic messages around the world,” he added.

Request for inclusion in the European Charter of Fundamental Rights
The SPÖ MP and Vice President of the EU Parliament, Evelyn Regner, welcomed the move. “This political decision is of critical importance to women around the world, as it ensures women’s self-determination over their own bodies, regardless of current political majorities, and recognizes it as a fundamental right. We have only recently seen how relevant this is in the US, where women’s access to a safe abortion that was considered safe is no longer guaranteed,” Regner said Thursday.

France plays an important role as a role model, as access to abortion is currently under attack in the European Union, the vice president continued. The aim should be to guarantee access to safe abortions for all women across the EU – Austria must also follow suit. “The right to a legal, safe and voluntary abortion should be included in the European Charter of Fundamental Rights,” Regner demanded.

Compromise formula found, but still far away
A first attempt to enshrine the ‘right’ of women in the French constitution failed in October in the Senate. Republican senator Philippe Bas then proposed a compromise formula that did not mention the “right” to abortion, but the woman’s “freedom” to choose it.

However, there is still a long way to go before the constitution is amended. The text must be adopted verbatim by both chambers of Parliament. Then there must be a referendum.
