The Social Court number 2 of Bilbao has a Absolute permanent disability as a result of an accident at work to a nurse, a health center worker, who was diagnosed with persistent Covid. The ELA union went to court, which eventually sided with the worker.
This guard contracted a coronavirus infection in March 2020. He was subsequently diagnosed with Long or Persistent Covid, Post-Covid Chronic Fatigue Syndrome, Severe Depressive Syndrome Responding to Persistent Covid, and moderate cognitive impairment.
As a result of the pathology, the worker suffers from fatigue, dizziness, instability, insomnia, mental fogginess and tachycardia, as well as cognitive decline affecting concentrated and sustained attention, processing speed and working memory. All this is “incompatible with work performance”, according to what is reported in the note published by the ELA union.
ELA was very pleased with the punishment because “it recognizes the pathology of the permanent covid that has left many employees with serious consequences”. Likewise, it has reported that the resolution allows the Bidelagun Foundation, ELA’s occupational health foundation, to seek a surcharge on benefits for non-compliance with compensation and preventive measures by the company.
According to the union, staff working in the first wave of the pandemic even acted without adequate protective measures.
