The new list includes areas that facilitate businesses with no real economic activity, have very low taxes, or do not exchange tax information.
The Ministry of Finance and Public Functions has updated the list of countries and territories that are considered tax havens, that is, those places that are considered “harmful tax regimes or uncooperative jurisdictions”.
In this way, the Ministry complies with the provisions of the Measures to Prevent and Combat Tax Fraud Act; a rule that, with the aim of combating tax fraud, expanded the concept of “tax haven” to adapt it to the international concept of “uncooperative jurisdiction” and established new factors.
Therefore, this new list includes those places that facilitate the existence of offshore companies that aim to attract benefits but have no real economic activity, areas that have no or very low taxes, and also areas with which no effective tax information is exchanged.
The first list of this type, drawn up 30 years ago, had 48 territory names. Over the years it has been lowered as information sharing agreements have been signed.
The latest list, updated by the Ministry of Finance and published today in the BOE, includes the following countries and territories:

• Samoa (regarding the offshore business)
