It’s an abusive relationship from the book. He beats her for no reason, they keep getting back together. She wants to protect him despite another day’s ordeal that ended in intensive care. Now a 33-year-old was sentenced to five years in prison – and then some.
“I didn’t want to say anything at first because he was just released from prison”, “I didn’t want him to go back to prison because of me” – the testimony of the 35-year-old victim was read by the judge saved the Linzerin from confrontation with tormentor and lover in personal union. The judge clearly said that one could also be “in a completely different constellation” here – not “only” because of intentional grievous bodily harm, but because of attempted murder.
Fourth appearance in court
The duo met and fell in love during alcohol rehab. Was then together and apart. Again and again, blows fell and the suspect was sentenced to three times. Alcohol was always involved. And unfounded violence. There were repeated paroles, 28 months suspended prison sentence still outstanding at the beginning of the hearing. And the new law took place during the probationary period. The sentence was therefore increased from one to ten years to two to fifteen years.
The couple, which was actually no longer a couple, kept getting back together. The woman had no one else in her life, lived with her parents after the divorce and, like the defendant, had broken down the rehab clinic.
Three days of martyrdom
The 33-year-old is said to have repeatedly beaten, strangled and thrown the woman from Linz into a hotel in Linz for three days in October “where they wanted to enjoy themselves with a lot of alcohol”. It wasn’t until she was so bad that he was “worried” that he called rescue: brain hemorrhage, numerous bruises, both eyes blue, strangulation marks, lacerations – the body was truly black and blue.
The police’s first question after the arrest: “Is she still alive?” “But that was only because I had no information and I was really worried,” said the suspect, who – against the strategy of the public defender – who also caused injuries by falling into a 3.4 promille drunk – laid a full confession. “That was the best idea of the day,” says the prosecutor, and, “We’re talking up or down a few years.”
The jury panel – a female judge and two female jurors – quickly ruled: 5 years in prison plus 8 months, which were taken off the suspended sentences. “Thank you very much,” said the defendant. The verdict is already final.
