“Laesio enormis”: Whoever collects too much violates this legal principle! A Carinthian family even paid ten times as much – the ticketing platform “viagogo” often attracted attention with such outrageous deals.
Red Bull Salzburg vs. AS Roma: You could have gotten tickets for the match for about 40 euros. A Carinthian family, on the other hand, bought a Swiss ticket platform that was already known to the court – and paid 1500 euros for four people! “The case shows that the ticket platform is lighting up again,” warns Herwig Höfferer of the Carinthian Workers’ Chamber: “We have been warning about viagogo for years.” The Carinthians would have thought that the tickets for the match were just as expensive. But when they received them, they discovered the price of 38 and 42 euros.
AK intervenes
“Viagogo is a company headquartered in Switzerland,” explains Höfferer. “Legal enforcement is therefore difficult and often associated with high costs and exceptional litigation risks. However, we will intervene on the platform, which was no longer listed on Google searches until recently.
Violation of the rule of law
With these extremely high prices, the company violates the legal principle of “Laesio enormis” (reduction by more than half) – that’s what the law says if you have to pay more than double for goods or services. If this principle applies, the transaction is legally invalid – but only in Austria. The AK is investigating the case; As reported, the Supreme Court has already invalidated 42 viagogo clauses.
