First she offered temporary shelter to a needy homeless person, then she attacked him completely out of the blue – driven by her mental illness. Voices ordered her to attack the man with a knife and hammer. Can a lay judge decide on a referral in this case?

“We are actually friends. We are not enemies,” says the 31-year-old in the Viennese court about a homeless person she took in. The Poles attacked them with a knife and a hammer.

But why would a young woman let a homeless man live with her first and then try to hurt him? “She felt that the man’s ‘ghost’ was raping her,” the prosecutor said. This means the spirit of Poland. The person concerned suffers from paranoid schizophrenia – she hears voices.

And it was precisely these voices that advised her to “stab him in the heart until he dies.” This was also confirmed by police officers called to the crime scene. The description of the operation: “Woman has been raped and demands immediate police intervention, otherwise she would kill the perpetrator,” describes one of the officers. The person concerned had made an emergency call himself.

However, the picture presented to the emergency services was a completely different picture: the Pole was hidden behind a metal grille with a bleeding cut on his hand, and the victim was clearly not the victim. On the contrary, the 31-year-old allegedly stormed out of her bedroom out of nowhere – a knife in one hand and a hammer in the other. The homeless person made coffee: “Everything was fine. I don’t know why she attacked me.”

Victim forgiven in court
Apart from a cut to the middle finger and a bruise around the ribs, the 50-year-old man suffered no injuries. Nor does he hold a grudge against the woman who once offered him a roof over his head. The man left the courtroom and said, “Please don’t hurt her. I feel so sorry for her.”

The judge assured the witness that it was not a conviction anyway. Only the Senate must decide on the admission of the 31-year-old. She has been suffering from psychotic attacks since she was 27 years old. First caused by cannabis use. The woman was not aware of the disease until the end – despite repeated treatments. Defense attorney Anna Mair (law firm Astrid Wagner) sees change: “Since the incident, she wants therapy.”

Does the reason for admission change?
The decision on the 31-year-old’s housing will have to wait. Since she told both 911 and the police officers that she wanted to kill the “rapist,” the reason for the confession could change. Instead of the attempted grievous bodily harm, it could be attempted murder. Therefore, the lay judge pronounces a judgment of incompetence. A jury must decide on the housing of the 31-year-old.
