Girl (1) died – child rolls over: Postler takes action against fine

Date:

Because he hit and killed a girl (1) with his van in Annaberg (Tennengau/Salzburg) in May last year, a postal worker (57) was fined 4,510 euros last Thursday. Now the man’s lawyer is taking action against the verdict.

“We advocate nullity, guilt and punishment,” confirms lawyer Lukas Kofler. The first instance decision of the Hallein Court of March 9 is now under review by a senate of the Salzburg Regional Court. The 57-year-old postal worker pleaded not guilty at Thursday’s trial. Although he protested that he was infinitely sorry for the incident.

A little carelessness cost a girl her life
On May 3, 2022 at around 8:20 a.m., the 57-year-old drove his van to the side of a municipal road in Annaberg (Tennengau/Salzburg). There were the brothers (9 and 4 years old) of the later victim. “The girl stood on the doorstep of the house and turned her back to me,” recalled the visibly moved defendant during his trial. “Then I reached into a box on the passenger side and handed the mail to the two kids. I do that often,” the postman continued. After a short conversation, he closed the window, looked around and drove off. Almost in tears, he continued: “Suddenly I heard a ‘Tuscher’. I stopped and looked in the mirror. Then the little one lay there.”

The judge ruled mildly
The judge even gave a mild verdict. The fine is one-sixth of the possible penalty. “But I believe the accident could have been prevented and it would have been reasonable for them,” he justified the guilty verdict. The liability insurance has now paid out 50,000 euros to the parents of the victim.
