In the summer of 2021, a gendarme in Vienna reported a woman for insulting officials after an operation for domestic violence. And now it’s in court. And was convicted.
“When you talk to your husband like that, I’m not surprised he yells.” Or: “I locked up women with children because they wouldn’t stop talking” – phrases like this emerged in June 2021 during an official deed in an apartment in Vienna-Floridsdorf. They come from the mouth of the suspect, a police officer.
Reporting abusive officials
But they are not the reason why the 26-year-old was in court in Vienna. The accusation is rather abuse of office. Because the civil servant missed the woman to whom he said the statements, an administrative law report for insulting civil servants and noise nuisance. What he didn’t know: There are audio recordings of the operation.
The woman was very afraid of her husband
The story is tricky. In short: the victim’s husband called the police that evening because his wife had taken the key from him. Three inexperienced officers rushed over and questioned the pair separately. The suspect took over the conversation with the woman, who protested that she was afraid of her husband.
Overwhelming situation for young civil servant trio
“It was very loud, confusing and hectic,” the suspect recalls that Mrs. H.’s constant interruptions annoyed him. There was a reason for her excitement: “I was a victim of violence. My husband has an alcohol and drug problem,” says the now divorced mother as a witness. That was why she didn’t want him in the same apartment with the kids at the time. Five days after the operation, the policeman wrote in his ad that the woman had screamed: “I didn’t think there were such stupid and incompetent police officers in Austria!” – but in the recording of the mobile phone nothing can be heard !
Mild judgement, not final
On the contrary, the police students present in the courtroom heard on the tape the Polish resident saying: “I would have thought that Austria is a good country for women and children.” .
