Tragedy in Tyrol – Leon’s father remains in custody? decision postponed!

The waiting for the decision whether the imposition of pre-trial detention on the father of the drowned Leon (6) is justified continues! Because: The Oberlandesgericht Innsbruck (OLG) announced today, Friday, that this question can only be clarified at the beginning of next week.

A joint walk of father and son at the end of August 2022 ended – as widely reported – in a nightmare! The severely disabled six-year-old – he suffered from Syngap syndrome, a rare genetic defect – is dead, drowned in the Kitzbüheler Ache. His father is said to have been attacked by an unknown person shortly before and knocked unconscious.

Sudden turn in this case
The detectives initially also assumed this version, but suddenly the tide turned: the 38-year-old became the target of the police. The indications that he wanted to save his own son from his misery and therefore killed him would have become so hard during the investigation that the 38-year-old was arrested. He has been in custody ever since.

‘Of course my client did not kill his son’
However, the suspect fought back and filed a complaint against this decision with his lawyer Hubert Stanglechner. Because: “Of course my client did not kill his son. He resolutely rejects all allegations!” His lawyer has already referred to the evidence several times – as also reported – and emphasized that it is “incomprehensible, in some cases even absurd”.

Higher Regional Court speaks of “extensions in the criminal case”
At the beginning of this week, Klaus Dieter Gosch, vice president of the Higher Regional Court and media spokesman, told the “Tiroler Krone” that a decision on the complaint would be made later this week. But that is not the case, as an official broadcast now says: “Due to further developments in the criminal case in connection with the death of little Leon in St. Johann in Tirol, it is to be expected that the Oberlandesgericht Innsbruck will not take action until next week action on the question of whether the imposition of parental authority on the father is justified.” In concrete terms, this means that further research results must be taken into account.

A press release will be sent once a decision has been made by the responsible senate of the Higher Regional Court and the parties involved in the proceedings, it is stressed. Gosch said in today’s conversation with the “Tiroler Krone” that the decision will likely be available next Tuesday. “I can’t give any further details about that,” adds Gosch.
