The Labor Inspectorate will send 340 letters this week to as many companies to review 1,766 allegedly irregular contracts because they used temporary employment agencies (ETT) to cover structural needs.
The Ministry of Labor and Employment of the Basque government has explained that these situations are detected by means of an anti-fraud computer application that can cross-cross data to try to detect regulatory breaches in contract matters.
The letters explain that the repeated use of agency hiring (ETT) to cover structural needs constitutes a fraudulent act, whether that hiring is formalized with temporary, intermittent permanent or regular permanent contracts.
Of the 340 letters, 110 correspond to companies in Álava with 703 contracts affected, 88 to Gipuzkoa with 471 contracts and 142 to Bizkaia, where 592 contracts need to be reviewed.
The 12 ETTs involved (6 from Biscay, 3 from Alava and 3 from Gipuzkoa) will also receive a message letting them know that if the hiring company has not converted the irregular contracts into their own regular regular contracts within a month, they may be subject to action inspector.
