The man from the Tyrolean Unterland pleaded “not guilty” at the beginning of the trial. However, the situation was clear to the public prosecutor after the investigation: between May 2017 and March 2022, the suspect had several times immorally touched his stepdaughter, who was born in 2010.
“He took advantage of the situation that he was alone with her and stroked her several times above her clothes on her breasts and in the vaginal area,” said the prosecutor. The defendant could therefore be found guilty without any doubt.
“No Sex Acts Happened”
The defense attorney, of course, followed a different strategy: “My client never actually engaged in sexual acts with the child!” The criminal offense of sexual abuse was therefore also not completed, so that the suspect had to be acquitted. You should also ask yourself who you believe more — a “now 12-year-old girl or a 75-year-old man,” the defense attorney said. The man, who had said nothing about the allegations before the trial, finally broke his silence at the Innsbruck court on Monday, but was unable to explain his stepdaughter’s allegations.
The jury was finally convinced of the credibility of the victim, who is undergoing psychiatric treatment, and imposed a prison sentence of 12 months (of which nine months were suspended) and 2,500 euros in compensation for pain and suffering. Aggravation of the long period of crime was assessed. The verdict is not final.
