The Biden administration has seven days to appeal the verdict. Kamala Harris has denounced that it is an “attempt by certain politicians to tell the Drugs Agency what to do”.
A federal judge in Texas this Friday issued a delay that would end prescription and distribution nationwide within seven days mifepristoneone of the two drugs used to medically break down and which has been distributed in the US market by the Food and Drug Administration (FDA) for more than two decades.
the district judge, Matthew Kacsmarykappointed by former President Trump, the administration has given a week to appeal before his ruling takes effect.
The lawsuit against the FDA, brought by doctors and anti-abortion associations, alleges that the drug is not safe and alleges that the FDA did not study it carefully enough before approving it in 2002.
A second federal judge, this time from Washington state, Thomas Owen Rice, ruled in a new ruling a few hours later that the drug should be upheld in at least 12 states: “It is not the role of the Court to evidence and decide whether the benefits of mifepristone outweigh the risks without REMS and/or ETASU. That is exactly the role of the FDA.” The states it would remain in are: Washington, Oregon, Arizona, Colorado, Connecticut, Delaware, Illinois, New Mexico, Rhode Island, Vermont, Hawaii, Maine, Maryland, and Minnesota.
the vice president Camala Harris, who has championed the reproductive rights case in the Biden administration, said the court ruling sets a “dangerous precedent”. “It is against good public policy to allow courts and politicians to tell the FDA what to do,” Harris said.
Planned Parenthood, the largest network of reproductive clinics in the US, rejected the ruling in a statement, saying it is an “unprecedented and deeply damaging measure.”
According to Guttmacher Institute data, medical abortions will account for 54% of all abortions in the US by 2022.
