Court lowers sentence – hammer blow: woman remained silent for brutal husband

After a bloody hammer attack in Innsbruck, a Serb (35) and his injured wife made up a robbery story. The battered woman remained silent, but he was sentenced last November to 17 years in prison, which the higher regional court lowered on appeal on Thursday.

Beatings with a hammer, then a violent kick to the head – the Serb had treated his wife in the Innsbruck apartment with incredible cruelty. At the trial last November, the jury ruled that there was attempted murder. The woman was lucky, the bleeding wounds had no lasting consequences.

The Serb then called the emergency number. “Your head is broken. Someone tried to kill her,” the fairytale went. There was talk of a robbery after her night shift – also on the part of the woman!

Traces of blood have been wiped everywhere
The researchers used luminol (makes traces of blood visible) and were stunned: there were traces of blood everywhere in the rooms. A hammer with blood residue was found in a toolbox – the suspected murder weapon. A print of a lady’s slipper that came to light revealed terrible things: the victim must have had to wipe her blood off the floor herself!

Despite this story of suffering, during the first trial, the woman remained silent and did not burden the man. However, in an exchange of letters with the prisoner at the time, the gross abuse was mentioned and he admitted the “serious mistake”.

Two extra points counted as mitigation
In Thursday’s appeal, the Supreme Court ruled as mitigating two points that had previously been under-considered: his emergency call and the fact that he had no criminal record for the attempted murder (another case against him was still under appeal). . For example, instead of 17 years, he was sentenced to 15 years in prison.
