There are three main decisions of the Administrative Court of Upper Austria: Parents must pay the fines if their children stay out of school without reason or illegally. Because in Upper Austria, dozens of children are playing truant from school – and they are no longer allowed to have lessons at home because of failed or missed exams.
It is a small avalanche that rolls over the administrative court of Upper Austria. Because those three parents – mother and father were always punished separately – from Ried im Innkreis and Steyr-Land, who appealed against the sentences of the district authorities, are only the tip of the iceberg.
Kids MUST go to school now
The parents were fined 110 and 330 euros respectively because they did not send the children to school while the children were of school age. This is especially true if the children have been taught at home in the past year – due to Corona or the associated measures – but have not passed the external exam or have not even started. Then another year of homeschooling is no longer allowed. If the children do not return to school, the district administration must intervene and punish if the parents do not understand.
“The concerned parents or legal guardians filed complaints with the State Administrative Court against these penal decisions, raising in particular issues related to the child’s well-being and investigative situations. They also stated that they wanted to make their own decisions about the education of the schoolchildren,” reports the Upper Austrian Regional Administrative Court about the parents’ arguments and concluded that “the complaints should be rejected as unfounded”.
Three cases can quickly become several
Translated: The parents must pay the fines. And if the truancy continues, it will be punished again. “The three current rulings are authoritative, as they represent precedent decisions that will also be followed by the judiciary in the future,” the court says, adding: “Parties are of course free to go to the administrative or constitutional court.” And the parents will probably get it too.
