Because the doctor tampered with his patient’s pubic area, he was sued. Now he had to answer for abuse of power at the regional court in Feldkirch.
“I’m sorry it all turned out this way. But my intention was never sexual. I just wanted to examine the woman properly,” says the 51-year-old doctor who has Parkinson’s disease. At the end of June last year, he had clearly examined a patient too intensively who suffered from numbness in the pubic area after a herniated disc. “I had to free myself downstairs. Then he started pressing on my clitoris and later he put a finger in my vagina and buttocks,” said the 31-year-old patient during her examination.
Private Report: Insanity existed
The woman then stopped the treatment and told her boyfriend what had happened. He confronted the doctor who treated him and forced a confession from him. The next day, the 51-year-old was released without notice. At the first hearing in mid-February, the formerly impeccable man apologized for his behavior, which he attributed to a loss of impulse control from taking so-called “dopamine agonists” and their side effects.
Regina Katzenschlager, specialist in neurology and psychiatry and vice president of the Austrian Parkinson Society, concluded in a private report commissioned by the defendant that at the time of the crime the doctor was suffering from a massive loss of impulses and that he was unhealthy.
Confession should carry more weight
Both representatives of private parties and the Public Prosecution Service contradicted this and referred to the statements of the victim and the signed confession of the suspect.
Judge Martin Mitteregger: “From a human point of view, there are always multiple victims.” The verdict reads: Nine months partially suspended prison sentence and 2,000 euros compensation for pain and suffering to the patient. However, lawyer Alexander Fetz said he wanted to challenge the verdict.
