Exactly three months ago today, the trial against former actor Florian Teichtmeister for possession of child abuse files should have taken place at the Vienna Regional Court. The hearing had to be cleared. He was “seriously ill”. Discussion has now been restored, but a date for the main hearing has not yet been set.
“The investigation ordered by the responsible judge has not yet been completed. The results of the investigation are not yet available,” said court spokeswoman Christina Salzborn over the weekend. However, these are essential to clarify who is responsible and for the legal classification.
The delays in this case had nothing to do with the person of the suspect and health reasons. As Salzborn emphasized, the outstanding documents have already been urged by the court. He is therefore keen to get the negotiations off the ground as soon as possible.
fines increased significantly
The public prosecutor has been investigating Teichtmeister since 2021 and the request for punishment was submitted to the regional court at the end of 2022. The cabinet used the case to tighten up the penalties for acquiring, possessing and passing on or trading images of abuse by children and young people. Since retroactive criminal law is prohibited, the actor is no longer affected in the event of a conviction – regardless of when the trial against him takes place.
The Teichtmeister case
The public prosecutor of Vienna has accused Teichtmeister of obtaining tens of thousands of files between February 2008 and the summer of 2021 depicting abused children and young people. According to the indictment, Teichtmeister would have stored the material in question on two smartphones, two laptops, a desktop, three external hard drives, a USB stick and three memory cards.
The data was secured and evaluated – but apparently it was not initially clear whether only children or minors appear on the protected files.
