Samantha was raped to death. Her two killers – 26-year-old Fabian W. and 31-year-old Manuel H. – were sentenced to life imprisonment. In addition, due to his dangerous nature, he was placed in a forensic therapeutic center. The Vienna Higher Regional Court has now upheld the jury’s highest verdict.
Hardly anyone was indifferent to the gruesome murder of Samantha during the trial before the Vienna Regional Court in March. The 20-year-old was raped and brutally injured with objects by two young men for so long that she eventually bled to death. The two only thought of calling 911 in the morning, when the young woman had long since died…
Despite the confession, no less lenient punishment
While the younger of the two suspects always denied being involved in the fatal rape, after all he would have had a kind of plus friendship with Samantha, Manuel H. made a clean sweep. And heavily accused his friend when he described the horrific details of the crime.
But this admission ultimately did not help the 31-year-old. Both he and the 26-year-old were given the maximum sentence: life imprisonment and a briefing for dangerousness. Both suffer from a combined personality disorder. Expert Peter Hofmann said of the older man: “There are certain types of offenders who use torture to achieve inner satisfaction for themselves. This is a very, very special group of perpetrators.” And that’s what it was, according to the court psychiatrist: a “sexually sadistic act” using torture methods.
At the Higher Regional Court with rejected criminal appeal
Fabian W. maintained his innocence even after the verdict was handed down, and immediately declared a null and full appeal to attorney Astrid Wagner. The defense of the second suspect asked for reflection time, but now also appealed against the amount of the sentence.
But with little success. Because the Higher Regional Court upheld the life sentences and briefing against the two young men. The verdicts in the gruesome murder case of 20-year-old Samantha are final. Rarely would the presiding judge have witnessed such a brutal and gruesome case with such massive violence. The Higher Regional Court sees no other option than to confirm life imprisonment.
