The defendant has suffered from bipolar disorder for 30 years. Numerous stays at the state hospital in Rankweil and changing medications testify to efforts to control the patient’s manic-depressive psychoses and thus enable him to lead a reasonably normal life.
Back home and well adjusted to the medication, the 73-year-old finally stopped taking his pills last year during a manic phase. The consequences are fatal: in the early hours of the morning, in early August, the mentally ill man rages in his house, shouting: “I am the strongest god of them all!” When his 48-year-old son turned to him with the phrase “Have you lost your mind?” wants to show the barriers, the screaming father on the top floor of the house pours heated frying oil on his son. During the attack, the victim suffered burns to his upper body and thighs. After the crime, the confused father is taken to Rankweil State Hospital, undergoes a psychiatric evaluation and is subsequently diagnosed as insane.
During the trial in the lay court in Feldkirch, the person concerned cannot remember what happened. “But I believe my son,” says the pensioner, who can live alone in his house again thanks to the administration of a new drug. Both the jury and the patient agree with the verdict of Primar Reinhard Haller, who does not consider inpatient admission necessary under certain conditions. Means: weekly care by the psychosocial service and regular check-ups by the psychiatrist.
