A girl was almost abused by a resident in her own room. The 16-year-old vehemently denied this in court in Vienna. His lawyer even accused the 12-year-old of “oversexualized behaviour”.
The girl was already living in a residential care home. Where only children and young people from the most difficult environments are taken care of. Psychological support was required beforehand.
“After this incident, she now shows more and more psychological problems, she lives completely introspectively,” the victim’s representative told the court in Vienna – her client is only 12 years old.
Sneaked into the shared room in the evening
In May last year, a 16-year-old – from the same apartment – attempted to rape her. Not for the first time: “There have been incidents before. She decided not to take it anymore, to fight back.” Because when the teen snuck into her room late at night and would have already pulled his pants down, she screamed.
Victim would ‘just tell stories’
An evening that the defendant says he experienced in a completely different way. There were problems with the shared Netflix account that he wanted to clear up. The 12-year-old then undressed him. His lawyer even locates “oversexualized behavior”
But not the judges. Trembling, he accepts his verdict: six months suspended prison sentence for serious sexual abuse of minors – not legally binding.
