“Only” abuse – proven rape, yet acquitted

Several girls were abused by a young person. The 22-year-old presents himself as an innocent lamb in the Eisenstadt regional court.

The suspect is said to have sexually abused several girls between 11 and 13 years old between 2017 and 2019. The suspect was only 17 years old when the crimes began. At the age of 19, according to a later victim, he raped his own girlfriend (then 15).

“I didn’t know it wasn’t normal”
The suspect has been released from custody. “He was my first boyfriend. I didn’t know what he was doing was not normal,” said a 19-year-old witness. Marcel D. wanted nothing to do with abuse or rape. He admitted to having had individual sexual contacts, but they were consensual. In addition, the girls would have looked older than 14.

Three years partially suspended
The court admitted the rape, but acquitted the perpetrator on this point: “You committed the crime, but you cannot prove intent.” The sexual abuse was sentenced to three years, two of which were suspended. Not legally binding.
