With the scam, the man living in the Netherlands took over the “legacy” of his father (56), who was convicted of the same scam years ago. “I didn’t know what the pots were actually worth,” the junior denied any intention to cheat. To the best of his knowledge and belief, he resold the purchased crockery to interested parties.
The suspect deliberately indicated an expensive brand
The public prosecutor saw it differently: “Defendant deliberately mentioned the name of a well-known manufacturer that is associated with high-quality tableware.” The defense attorney contradicted this: “Not only was my client only 20 years old at the time, he actually thought it was of good quality.”
In turn, the three witnesses interviewed gave a clear picture of the fraud process, which caused a total of 4760 euros in damage. For example, the man told them that he “had to go to Switzerland urgently” and that he could leave the crockery with them cheaply because otherwise he would have to declare it expensive. “He touted the dishes as a great commodity and an equally great opportunity,” a witness testified.
The judge gave several reasons for the lenient sentence
Judge Andreas Fleckl eventually admitted fraud. However, he left it – not legally binding – with compensation for the misled customers and a one-year trial period. He cited the integrity of the suspect as arguments for the lenient sentence, and the crime was ten years old. In addition, the damage has been repaired.
