Sting in the eye – Three years in prison after senseless umbrella attack

It should have been a merry evening among comrades, but the celebration among soldiers ended on the night of February 24 with an umbrella attack. Since then, the victim has been battling signs of paralysis and visual impairment. The young perpetrator (21) was sentenced by the court in Upper Austria on Thursday to three years in prison, one of which is unconditional.

A large scar on the head, a walking stick for support: the victim was scarred during the trial in Steyr on Thursday from the attack in February – and will remain so for the rest of his life. Actually, the NCOs wanted to celebrate their success before being dismantled by the Defense Secretary. Graduates from all over the country came together for this. The perpetrator and the later victim did not know each other beforehand and only met later in the evening in the Schlossbar in Enns.

Harassed several guests
There, the heavily drunk 21-year-old from Mattighofen would have “become annoying” and “cram”. According to the public prosecutor’s office and also according to witness statements, the young man would have uttered “completely senseless harassment” several times. Above all, the 33-year-old comrade from Mistelbach would have been insulted several times by the 21-year-old – but apparently other guests also had to endure hostilities. As it turned out in court, it is not uncommon for the suspect to have drunk too much. The whole thing escalated on the way home to the restaurant. Again, the suspect allegedly insulted the victim.

Bone fragments ended up in the brain
Then followed, according to forensic medicine, a “forceful push from a short distance” with a red umbrella. The suspect had taken the umbrella from the bar, although it was not his and it was not raining. The murder weapon had a metal tip. This pierced the victim’s skin below the right eye, a bone and protruded several inches into the 33-year-old’s brain. There’s a bone splinter lodged in the brain. The severity of the injuries was only determined this morning.

Judge after a few minutes
In court, the defendant confessed in full and was guilty as charged – intentionally causing grievous bodily harm. He has not had a sip of alcohol since the attack. The jury took only a few minutes to reach a verdict. The Innviertler was sentenced to three years in prison, one year of which was mandatory. The two and a half months he had to spend in custody were credited to him. The verdict is already final.
