Be careful when choosing emoji! In Canada, the thumbs-up sign cost a farmer a lot of money. One of the reasons for this is a purchase contract that was handled by mobile phone.
A South West Terminal buyer had texted several farmers offering to buy 86 tons of flax. Farmer Chris Achter agreed with a thumbs up, but does not want a digital signature.
There was no delivery, but prices have risen in the meantime. The buyer suffered damage as a result of the increase. A judge has now ruled that an emoji is seen as a signature and that the farmer must compensate the financial damage.
Damage amount of 56,500 euros
There is a difference of 56,500 euros between the originally agreed price and the later market price. The lawyer argued that it was an unusual form of signature. However, such forms of consent could very well be done this way today.
