In Self Defense – Rabid mother locked in her basement

A 33-year-old Unterländer was tried in Vorarlberg on Tuesday for deprivation of liberty and bodily harm.

For a long time, the 56-year-old mother and her son were not completely green. There was always a fight between the two. So also on June 21.

When the 33-year-old wants to help her clean up the basement, the woman attacks her son. He immediately assumes a defensive stance, holding his arms protectively over his face and body. He hits his mother in the stomach with his foot. Shortly afterwards, he locks the angry woman in the basement by attaching a piece of chipboard to the door, which he removes a minute later. The furious then filed a complaint for deprivation of liberty and bodily harm.

Acquittal for the 33-year-old suspect
While the victim called as a witness remained silent during the interrogation yesterday, the suspect justified his lock-in action as follows: “It was a self-defense situation. I just wanted to buy time.” Prosecutor Wilfried Siegele cannot understand that at all. In his more than 40 years of professional experience, he has never seen anyone force and hold the mother by locking her up with a piece of chipboard. That is why he is asking for a guilty verdict as charged.

Ultimately, however, Herr Rat followed the explanation of the defense and acquitted the accused son of the charges against him. Lawyer Astrid Nagel: “The minimum detention time of ten minutes was not given. There was also an elevator in the basement and a second exit. So the victim could have left at any time.”
