It started with flattery that he liked her so much that she was the most beautiful colleague. Last November, the chef of a posh Viennese restaurant in the 8th arrondissement went too far: he grabbed the buttocks of the 23-year-old waitress and later harassed her in the grocery store.
“If I want to rape you, I can!”
“He said if he wants to rape me, he can do it too,” the victim recalled. The cook then threatened her that he would hit her if she told anything about what had happened. The man had become aggressive again and again – especially when he had been drinking alcohol at work. Other soldiers spoke of shouting and verbal abuse, once he angrily waved a fish through the air.
Victims and another waiter were fired
After the attack in the grocery store, the young woman immediately turned to her colleague and friend. Later also to her boss, who did not believe her the abuse. “I was fired by mutual consent,” said the 23-year-old, to the horror of all involved in the trial and onlookers. Her boyfriend – during a conversation he punched the 59-year-old cook in the face – was fired without warning via text message: “I think we were the lesser evil. You can always find waiting staff.” Only the suspect is still working in the restaurant kitchen…
The 15-month suspended prison sentence for sexual harassment has now been suspended by the Vienna Regional Court. “It was clearly a show of force. You humiliated the woman. That goes way too far,” explains Judge Apostol. Although the 59-year-old always speaks of a conspiracy against him, he denies the allegations, eventually accepting the verdict.
